Current News and events regarding Elder Law matters.
“Minnesota is still living with the medical assistance laws and regulations in effect in July of 2009.” When the variety of stimulus bills were passed during the last 12 to 18 months, one of the side effects of states accepting the federal monies was an agreement by the states not to change their rules affecting medicaid eligibility in a way that made them more restrictive than the law and regulations that were in effect on July of 2009. When Governor Dayton signed his first executive order which accepted more federal funds for the state’s medical assistance program, that clearly cemented Minnesota into maintaining pre-July 2009 rules.

This is all good news for those in Minnesota that need to venture down the path of application for MA because there are still a few opportunities available to shelter and protect assets that will not be available when post-July 2009 state law and regulations are allowed to be implemented.
