Following the passage of DEFRA in February 2006, Medical Assistance planning, aka Medicaid planning, is in a state of flux. The Federal law has been passed but States need to follow suit to establish the framework to administer the new law at the State level.
Following the passage of DEFRA in February 2006, Medical Assistance planning, aka Medicaid planning, is in a state of flux. The Federal law has been passed but States need to follow suit to establish the framework to administer the new law at the State level.
The Minnesota Bar had its first shot at the topic yesterday, 3/27/2006, at their annual Medical Assistance CLE in Minneapolis, MN.
There was a very well presented series of discussions concerning the Federal changes, however since the State of MN has not yet had legislation introduced regarding the application the new law at the state level, there were a number of areas that had no specific answers to application answers.
One of teh audience questions during the Q&A periods was "Does DEFRA eliminate the need for MA planning?" Although some may see the sky falling, I feel that there are opportunities with change to grow and that opinion seemed to the feeling of several of teh leading attorneys that were presenting.
